The Law of Taking Back gifts that we have given to others

Meeting good people and being willing to give us something they really have made us happy. Unfortunately, in some cases, sometimes people have already given something to someone else, but in the future the person has taken the gift. Then, can this be done? How does the law take back the gift?

The Law of Taking Back gifts that we have given to others

In the book of Sunan at-Tirmidzi narrated from Ibn Umar how the Messenger of Allah (may peace be upon him) said:

لا يحل للرجل أن يعطي عطية ثم يرجع فيها إلا الوالد فيما يعطي ولده ومثل الذي يعطي العطية ثم يرجع فيها كمثل الكلب أكل حتى
إذا شبع قاء ثم عاد في قيئه

"The idea of a person giving a gift and then taking it back to him is like a dog eating a full meal and then vomiting it, and then eating it again." (HR.Tirmidzi)

In this hadith it is explained that the prohibition on taking back the gift given is the opinion of the majority of scholars. Why is that? Because whatever was given was either a gift or a gift, it is entirely his right to receive it, and indirectly we have inherited that gift physically and in possession. That is a bad example and does not include the morals of a Muslim.

However, there are certain conditions that make the act of attracting the gift possible. For example if a father gives something to his son and the father changes his mind, then the father can withdraw his gift for the purpose of enrichment.

It is said in Muslim history, "Be fair to your children!" When parents give their children gifts they should be fair and free of charge. Unless the family needs it more then, and then the child has the need, then it is better to provide it according to his needs and not excess.

Then another thing if the person who gave or received the gift or the gift voluntarily without any intention of giving back the gift to the person who gave it is allowed. In this case there is no problem between the giver and the recipient.

It can be said that in general, giving a person a gift or a gift is a fun thing. But if it is asked for by us again, then the law is illegal and the Messenger of Allah (may peace be upon him) like a dog that eats its vomit

The exception for a father who gives his son gifts is due to various reasons such as family benefits. For indeed the child is the property of his father, because it came from him, and every father also respects him.
